Renunciation/Surrender of Indian Passport

OVERSEAS CITIZEN OF INDIA (OCI) CARDHOLDER SCHEME

Every registered OCI will be issued a registration certificate which is printed like an Indian passport in different colour and will have the photograph of the individual and all necessary security features.

1. Benefits :

  1. Multiple entry lifelong visa for visiting India for any purpose. However, OCI Cardholders are not entitled to undertake any Research work, Missionary work, Mountaineering and Journalism in India without prior permission of the Government of India. OCI cardholder shall also require Protected Area Permit (PAP)/Restricted Area Permit (RAP) to visit any place which falls within the Protected/Restricted Area notified by the Government as in the case of any other foreigner.
  2. Exemption from registration with Foreigners Regional Registration Officer (FRRO) or Foreigners Registration Officer (FRO) for any length of stay in India.
  3. Parity with Non-Resident Indians (NRIs) in respect of all facilities available to them in economic, financial and educational fields except in matters relating to the acquisition of agricultural or plantation properties.
  4. Treated at par with the Non-Resident Indians in the matter of inter-country adoption of Indian children.
  5. Treated at par with resident Indian nationals in the matter of tariffs in air fares in domestic sectors in India.
  6. Shall be charged the same entry fee as domestic Indian visitors to visit national parks and wildlife sanctuaries in India.
  7. Parity with NRIs in respect of :- Entry fees to be charged for visiting the national monuments, historical sites and museums in India ;

Pursuing the following professions in India, in pursuance of the provisions contained in the relevant Acts, namely :-

(i) Doctors, dentists, nurses and pharmacists ;

(ii) Advocates ;

(iii) Architects ;

(iv) Chartered Accountants

To appear for the All India Pre-Medical Test or such other tests to make them eligible for admission in pursuance of the provisions contained in the relevant Acts.

2. Benefits to which OCI Cardholder is not entitled to :

  1. Not entitled to vote, be a member of Legislative Assembly or Legislative Council or Parliament, cannot hold Constitutional posts such as President, Vice President, Judge of Supreme Court or High Court, etc.
  2. Shall not be entitled for appointment to public services and posts in connection with the affairs of the Union or of any State except for appointment in such services and posts as the Central Government may, by special order, in that behalf, specify.
  3. Cannot acquire agricultural or plantation properties in India.

NO PERSON WHO OR EITHER OF WHOSE PARENTS/GRANDPARENTS/GREAT GRAND PARENTS IS OR HAD BEEN A CITIZEN OF PAKISTAN OR BANGLADESH SHALL BE ELIGIBLE FOR REGISTRATION AS AN OCI CARDHOLDER.

FOREIGN MILITARY OR POLICE PERSONNEL EITHER SERVING/RETIRED WILL NOT BE REGISTERED AS OCI CARDHOLDER.

1. Eligibility :

  1. Citizen of another country but was citizen/eligible to become citizen of India on or after 26.1.1950 ; OR Citizen of another country but belonged to a territory that became part of India after 15.08.1947 ; OR Who is a child/grandchild/great grandchild of above person ; OR
  2. Minor child of (a) ;OR
  3. Minor child whose both/one of the parents is a citizen of India ;OR
  4. Spouse of foreign origin of a citizen of India/OCI cardholder and whose marriage has been registered and subsisted for a continuous period of not less than 2 years immediately preceding the presentation of the application.

2. Registration :

  1. Log on to https://ociservices.gov.in
  2. Upload documents (self attested), photograph, [not less than 51x51 mm with 80% coverage of face, light colour background (not white), without border, front view, minimum dimensions are 200 x 200 pixels and maximum dimensions are 900 pixels x 900 pixels] and signature [in case of minors who cannot sign, left hand thumb impression]. Photograph and signature must be in JPEG/JPG format with max size 200 KB.
  3. After submission of the complete application online, the originals of the supporting documents have to be submitted by the applicants to the Indian Embassy/Consulate concerned for prior verification.
  4. If there is any deficiency in the application/uploaded documents/photograph, the Embassy/Consulate concerned shall inform the same to the applicant by email for necessary action.
  5. After verification of the documents with the originals and confirmation that application with all documents are in order, the application would be approved on the online system. Simultaneously, an auto mail will be sent to the applicant informing “Application received and is under process’.

3. Documents to be submitted (Please note that if the documents to be submitted are in a language other than English, translation in English language by an authorized translator would be required):

Proof of present citizenship :

  1. Copy of Passport with validity of 6 months.
  2. Copy of certificate of registration of citizenship.
  3. Cancelled/Surrendered Indian Passport with Surrender Certificate. (for those who have surrendered Indian Passport in or after 2010)

Evidence of address of the place of application :

  1. Copy of electricity bill/telephone bill in own/parents/grandparents/spouse name.
  2. If the above is in relatives name, undertaking from the relative that the foreigner is residing with him/her.
  3. Lease License in case of tenants.

Evidence of self/parents/grandparents/great grandparents, in the following cases (for cases covered by 1(a) above) :

a. Copy of Indian Passport; OR

b. Copy of Domicile/Nativity Certificate; OR

c. PIO/OCI Card of parents/spouse with documents to prove Indian origin; OR

d. Any other proof – Certificate of residence/place of birth of self/parents/grandparents issued by Magistrate/DM of the concerned place.

Evidence of relationship as parent/grandparent/great grandparent, if their Indian origin is claimed as basis for registration as OCI Cardholder (for cases covered by 1(b) above)

  1. Birth Certificate mentioning names of both parents. If issued by Foreign authority, to be apostilled/endorsed by the Mission.
  2. If parents are divorced, court order of dissolution of marriage, which specifically mentions that the legal custody of the child is with the parent who is applying for the OCI card is required. If the court order is in any foreign language, translation in English/Hindi by an authorized translator is to be enclosed.
  3. Birth Certificate from Birth Registrar to be supported by (i) education documents, if any (ii) documents of inherited landed property, if any.
  4. Marriage certificate of parents. (if not available, reasons)

Evidence in case of minor child whose both/ one of the parents is a citizen of India (for cases covered by 1(c) above)

  1. Copy of child’s Birth Certificate.
  2. Marriage Certificate of parents. (if not available, reasons)
  3. Copy of Indian Passport of parents/one of the parents/Domicile Certificate/Nativity Certificate/any other proof substantiating the status of the parents/one of the parents as being Indian citizen(s).
  4. If parents are divorced, court order of dissolution of marriage, which specifically mentions that the legal custody of the child is with the parent who is applying for the OCI card is required. If the court order is in any foreign language, translation in English/Hindi by an authorized translator is to be enclosed.

Evidence as spouse of foreign origin of a citizen of India/OCI Cardholder whose marriage has been registered and subsisted for a continuous period of not less than 2 years immediately preceding the presentation of the application (for cases covered by 1(d) above)

  1. Registered Marriage Certificate, if marriage solemnized in India. If marriage solemnized in foreign country, it should be apostilled/certified by the Mission. If Marriage Certificate is in foreign language, to be translated in English by authorized translator.
  2. In case of spouse of an Indian citizen, copy of Indian Passport of spouse/Domicile Certificate/Nativity Certificate of the Indian spouse/any other proof of being an Indian citizen.
  3. In case of spouse of an OCI cardholder, copy of present valid Passport of spouse, copy of OCI card of spouse and documents based upon which OCI card was issued to spouse.
  4. Declaration from Indian/OCI cardholder spouse stating that in case of divorce/separation/death of foreign spouse, it is his/her responsibility to surrender the OCI card to the Govt. of India.

4. Fee : € 216*

* In addition, consular surcharge of € 3 shall be levied.

OCI card in lieu of PIO card

Registration :

  1. Log on to https://ociservices.gov.in
  2. Upload only the following documents :
  • Copy of the valid passport.
  • Copy of the PIO card.

5. Fee : € 95*

OCI Miscellaneous Services

Can be availed by the OCI cardholders in the event of following contingencies :

  1. Issuance of new passport up to the age of 20 years of age and once after completing 50 years of age ;
  2. Change of personal particulars. (In case of change of nationality, he/she can be permitted to enter/exit on the strength of the OCI Card and valid passport of the new nationality provided the new nationality is not of that of Pakistan or Bangladesh) ;
  3. Loss/damage of OCI card ;
  4. Filling of wrong personal particulars while submitting online application ;
  5. Change of address/occupation of the OCI cardholder.

Procedure :

f. Applicants to log on to https://ociservices.gov.in

Applications under OCI Miscellaneous services should be submitted along with documents, photograph[not less than 51x51 mm with 80% coverage of face, light colour background(not white), without border, front view, minimum dimensions are 200 x 200 pixels and maximum dimensions are 900 pixels x 900 pixels] and signature[in case of minors who cannot sign, left hand thumb impression is required]. Photograph and signature must be in JPEG/JPG format with max size 200 KB. The original of the supporting documents have to be submitted to the Mission for prior verification. No hard copy of the application is to be submitted.

Documents to be uploaded :

a. In case of issuance of new passport :

A copy each of (i) OCI Card, (ii) new passport, and (iii) old passport.

b. In case of change of personal particulars :

Proof for each requested services like change of name, change of address and occupation is to be furnished. In case of change of address/occupation, new OCI document shall not be issued. Upon submission of online application, the data shall be captured and new address/occupation shall be printed which may be kept in the OCI booklet for record purpose. Payment of fee will not arise in such cases.

c. In case of theft/loss of OCI Card :

(i) A copy of the complaint lodged with police authorities. If the report is in foreign language, authorized translation is required.

(ii) Copy of the OCI card.

In case of loss/damage of OCI document, the service would be granted only after personal interview.

The grant or otherwise of the service(s) sought shall be ordinarily decided in one month from the date of acknowledgement of the application on the online system. Fee shall not be refunded if the requisite service(s) is/are not granted. The new OCI card shall be issued only after cancellation of the old OCI card.

Verification of supporting documents with the originals :

  1. Originals of the supporting documents have to be submitted by the applicants for prior verification.
  2. If there is any deficiency in the application/uploaded documents/photograph, Mission will inform the applicant by e-mail.
  3. After verification of the documents with the originals and if the application is in order, the application will be automatically acknowledged on the online system. Simultaneously, an auto mail will be sent to the applicant informing “Application received and is under process”.

Fee :

  1. for OCI Miscellaneous services :€ 20 *
  2. in case of loss/damage of OCI Card :€ 79 *
